The Workforce Connection Job Board Terms and Conditions of Use

These Terms and Conditions of Use (the “Terms”) constitute a legal agreement between you (except as otherwise defined herein, a “User” or “Employer”) and The Workforce Connection (TWC) for the use of posting jobs on TWC’s Jobs Board on TWC’s website (www.TheWorkforceConnection.org). Access to and use of the Jobs Board by any User is subject to these Terms, including any modifications or additions to these Terms from time to time issued by TWC and all applicable laws and regulations. Accessing or using the Jobs Board indicates that User has reviewed these Terms, agrees to be bound by these Terms, and represents and warrants to TWC that User is authorized to enter into and be bound by these Terms on User’s behalf or on behalf of the entity that User represents.

TWC maintains the Jobs Board to facilitate employers posting open positions for job seekers to view and apply for the position through a link provided by the employer. Access to this Jobs Board is limited to that activity. Any access or attempt to access other areas of the TWC computer system or other information contained on the system for any purposes is strictly prohibited.

Rules

  1. The Jobs Board on TWC’s website is provided as a free service intended to connect job seekers with employers and job postings. All information posted must be related to the puposes of the Jobs Board.
  2. “Users” shall be defined as Employers or Job Seekers, as well as anyone else who uses TWC’s website. “Employers” shall be defined as all employees and agents of the employer who use the Jobs Board to post job openings. “Job Seekers” shall be defined as anyone who uses the Jobs Board who is not an Employer.
  3. Users who are Job Seekers (“Job Seekers”) are permitted to view job postings. Job seekers do not apply for jobs directly on the TWC Jobs Board, but may visit a link provided by the employer poster to apply for the job directly with the employer. No personal information is collected from Job Seekers visiting our Jobs Board.
  4. Job postings must be truthful and accurate, providing a realistic representation of the job, company, and opportunities.
  5. Employers should only post genuine job openings with a legitimate intent to hire for the specific position listed.
  6. Employers may not reference any third party organization to the job unless the application process is being handled by the named third party.
  7. Those using the Job Board for the purpose of posting employment opportunities shall abide by all local, state, and federal laws with regard to hiring and employment
  8. Postings should not intentionally misrepresent the job, hiring company, or poster.
  9. Any non-traditional working conditions or compensation (e.g., independent contractor, part-time, commission-based) must be clearly disclosed.
  10. Job postings cannot advertise for “business opportunities” that require payments or recruitment of others, or that resemble franchises, multi-level marketing, or club memberships.
  11. Employers cannot charge job seekers a fee to access job postings or apply for positions.
  12. Users are prohibited from uploading or distributing any information subject to trademark, copyright, or other proprietary rights except with the express consent of the owner of the rights.
  13. Users shall exercise both common sense and courtesy when posting information and shall not use the Jobs Board to transmit defamatory, disparaging, obscene or offensive materials or communications.
  14. The information and materials posted on TWC’s Jobs Board by Employer Users may contain errors, omissions, or typographical errors or may be out of date. The information and materials posted on this Jobs Board are provided for informational purposes only and are not binding on TWC in any way.
  15. Users shall respect the security of the Job Board and shall not attempt to delete or revise material posted by any other user or to gain access to areas private to TWC.
  16. The Jobs Board is not to be accessed to conduct any activities that may be illegal. For example, the Job Board shall not be used to encourage software infringement, spreading of computer viruses, or other crimes.
  17. Links and references to other Internet Websites operated by third parties do not constitute sponsorship, endorsement, or approval by TWC of the content, policies, or practices of such linked or referenced Websites. Linked and referenced Websites are not operated, controlled, or maintained by TWC, and TWC is not responsible for the availability, content, policies, or practices of linked or referenced Websites. Links and references to other Websites are provided for User’s convenience only, and User accesses them at User’s own risk.
  18. TWC reserves the right to to delete inactive Employer accounts on TWC’s Jobs Board.
  19. The Job Board is not to be used in a manner that violates the bylaws or any other policies, procedures, rules or regulations of TWC.

Limitation of Liability and Indemnity

TWC makes no warranty, guarantee, or representation as to the accuracy, sufficiency, or security of information posted by users and assumes no responsibility or liability in connection with the use or misuse of such information. TWC assumes no liability or responsibility for the quality, safety or legality of the employment opportunities or biographical information posted, the accuracy or truthfulness of the listings, or the ability of employers to offer employment opportunities to candidates. TWC reserves the right to monitor job postings and remove postings that it believes are not in the best interests of those using the Jobs Board or the best interests of TWC.

TWC’s Jobs Board is solely a platform and has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party companies, content, websites, or services. We do not warrant the offerings of any of these third-party entities/individuals or their websites.

TWC, its officers, directors, and employees, assume no liability or responsibility for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use of, or inability to use, the Jobs Board, whether based on warranty, contract, tort, or any other legal theory, and whether or not the user is advised of the possibility of such damage.

Users who are Job Seekers accessing the Jobs Board shall indemnify and hold TWC harmless from and against any and all liability, claims, damages, losses, costs and expenses (including reasonable attorneys’ fees) relating to any acts or omissions of the users or to materials or information transmitted by users in connection with their use of the job board.

DISCLAIMER OF WARRANTY. THIS WEBSITE AND ALL WEBSITE CONTENT IS PROVIDED TO USER “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. USER ACCESSES THIS SITE AT USER’S OWN RISK.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole reasonable discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms or violation of any applicable law. We may also remove any content, including any job posting or application, for failure to comply with these Terms.
